A $4.85 million settlement has been proposed to resolve a class action claiming that Ross stores used deceptive pricing methods to entice consumers.
Class Members eligible for compensation in the Ross class action settlement include consumers who purchased one or more items with a Ross price tag that included a “compare at” price from a Ross store since June 20, 2011, who have not received a refund or credit for all purchases.
The Ross fake sale class action was filed in June 2015 by consumers claiming that the retailer’s “compare at” prices on sales tags were misleading.
According to the plaintiffs, these prices are not reflective of actual prices for the same item at other stores. Instead, “compare at” prices allegedly represent the prices of similar items or similar styles.
The Ross class action states that a lot of consumers shop at Ross because of its promise that shoppers can get name brand items for “20 to 60% below department store prices.”
However, the plaintiffs say that “compare at” price tags do not clearly inform shoppers that this is not a “true, bona fide” price comparison, rather it’s just a “reference” price.
After years of litigation, negotiations and mediation sessions, the Ross class action settlement was reached in October 2018 and will resolve the class action claims brought in the 2015 suit.
Under the $4.854 million Ross class action settlement, consumers can recover a Ross merchandise certificate to be used as store credit.
The amount of the merchandise certificate will vary depending on how many Class Members file valid claims. Class Members can also exchange the merchandise certificate for 75 percent of the credit’s value in cash.
The Ross class action settlement also allows Class counsel to ask for up to 25 percent of the total settlement fund as attorneys’ fees and court costs. Additionally, lead plaintiffs in the Ross fake sale class action will receive up to $5,000 each as a service award.
Ross does not admit any wrongdoing by settling the suit. Instead the settlement allows both parties to avoid the risks and costs associated with continued litigation.
Class Members have until May 31, 2019 to file a valid claim or opt out of the settlement.
Who’s Eligible
Consumers who purchased one or more items with a Ross price tag that included a “compare at” price from a Ross store since June 20, 2011, who have not received a refund or credit for all purchases.
Potential Award
Store credit in the form of a merchandise certificate or cash equal to 75 percent of the value of the merchandise certificate.

Got an automated phone call on Thursday, saying not to deposit the check dated June 10 because the account number was wrong. Instead, to wait for a new check dated June 17… and if you did deposit the June 10 check and incurred a fee, send proof of the fee to RosspricingSettlement@cptgroup.com. I had deposited June 10th check and did incur a $12 fee, so I emailed proof…

On 6/13 I deposited my $7.87 check using smartphone app.On 6/18 there is a “withdrawal” of $7.87
